He was 22 years old.

According to an affidavit, Ashley Mason was waiting in the queue behind the wheel of the fast food restaurant for food. A witness told the police that the passage where Desmond Joshua Jr. worked that night was secured and Mason was particularly “angry” about it. The witness stated that Mason got out of his car, yelled, and threatened to take “his man” to the Burger King.

At that point, the management reimbursed their money and asked them to leave. According to the arrest report, Mason parked the black limousine she was driving and sat in the BK parking lot for about five minutes. Then he drove off and returned a few minutes later with a white truck in tow. This truck was driven by a white man who “asked Joshua to fight”. The man was later identified as the accused gunman Kelvis Rodriguez-Tormes, 37.

Now the cell phones were down and a video was recording part of what had happened. The arrest report says witnesses and a video show: “The man put Desmond Joshua Jr. in a headlock and choked him.”

A witness intervened to break it and it worked, but it wasn’t over yet.

A witness told the Rodriguez-Tormes police: “You have 2 seconds before I shoot you.”

The affidavit says, “At that point, [a witness] saw the unidentified white man armed with a pistol, entered the driver’s seat of the white truck, rolled down the window, and heard,” You have two seconds before I see you shoot. ”

Shortly thereafter, the witness said he heard a shot and saw Joshua fall to the ground in the parking lot.

According to the Orange County Sheriff’s Office, they answered a call for the gunfight at around 7:30 p.m. On Saturday evening they tracked down Joshua, whom they described as a black man in his twenties who was wounded in the parking lot with a gunshot wound. He was taken to the hospital but pronounced dead when he arrived.

Mason was not charged with a crime, but questioned

After the shootout, Mason and Rodriguez-Tormes quickly left the scene in their respective vehicles, but MPs found it quickly.

The arrest report says Mason was asked what happened that night, but his interview is being edited. A spokesman for an Orange County sheriff told Heavy that no charges had been brought against the woman. They also say that they have “no idea what their relationship is like”.

The affidavit states that Rodriguez-Tormes “disassembled” and hid the weapon used. He also points out that he didn’t call 911 after the shooting.

Rodriguez-Tormes is a convicted criminal, so it was illegal for him to have a gun. He is charged with first-degree murder with a firearm, destruction of evidence and possession of a firearm by a convict.
