Newcastle District Court judge Roy Ellis said on Thursday that the May 4 trial could have been held if it had been conducted alone, but Hayne wanted a jury trial. Judge Ellis said there will not be enough time to organize a jury panel for May 4.
He also suggested that the current suspension of jury service during rehearsals due to the coronavirus crisis would likely be lifted in the coming weeks.
Defense attorney Phillip Boulten SC told the court in Sydney via video link that Hayne’s legal team considered a trial only by the judge “ very carefully ”, but the former NRL player said that ” he would prefer one jury trial.
Boulten said the Director of Public Prosecutions would have opposed a trial before a judge anyway.
Hayne, 32, pleaded not guilty to two counts of serious sexual assault involving a woman in Hunter Valley, NSW.
Ellis J. agreed to set aside the trial date on May 4 and ordered a new trial to begin on November 23.
Prosecutor Wayne Creasey SC said the Crown accepted the new trial date, but said it would return to court to request that the change be made again if the date was a problem for witnesses.
Hayne, who was excused from appearing on Thursday, will not have to appear in person until November 19 for the final reminder of the case to confirm which judge will preside over the trial.
The trial is expected to last two weeks.
Judge Ellis accepted a defense request to change Hayne’s bail so that he no longer has to report to the police once a week.
The case will be referred to the court on July 2 for a pre-trial subpoena hearing.
Jarryd Hayne Accused of Sexually Assaulting a Woman
Hayne is accused of sexually assaulting a 26-year-old woman on September 30, 2018 between 8 pm and 10 pm in Newcastle.
Court documents indicate that Hayne had sex with the woman without her consent and “unduly inflicted bodily harm”.

He has been on bail since his arrest and was allowed to travel to Western Australia in July 2019 to take a six-month missionary course at the Youth With A Mission center.
The court had previously heard that Hayne planned to stay in dormitory-style accommodations near the Christian Evangelical Center’s training campus with other men.
Hayne had to attend conferences and not drink alcohol.
Accounts of aggravated rape carry a maximum prison sentence of 20 years if Hayne is convicted.
