The oldest of the Hutchings had not competed in any similar event before taking part in the amateur competition on August 13, 2019 in Chukchansi Park, according to the lawsuit.
But he started to suffocate and collapsed within minutes of the food contest, the costume said. He was taken to hospital where he was later pronounced dead.
The coroner concluded that the cause of death was asphyxiation.
Martin Taleisnik, who represents the Hutchings family, argued that participants in professional nutrition competitions train and prepare their bodies for such events.
“But that’s not always the case in an amateur cooking competition,” Taleisnik told the newspaper.
“The drivers in this event should have made the competitors aware of the risks and taken measures to protect them.”
The lawsuit alleges unspecified damages from Fresno Sports and Events, the owners of the Fresno Grizzlies.
Fresno Sports and Events declined to comment, the newspaper reported.
