Thomas Latanowich Biography Thomas Latanowich Wiki
The trial date of the defendant, Yarmouth Police Sgt. Sean Gannon, is set for next year, but the location of the trial remains open
At a hearing on Monday, Barnstable Supreme Court Justice Kathe Tuttman set a date for Thomas Latanowich trial on August 2. He is charged with shooting and killing Gannon at Marstons Mills in 2018, while Gannon was part of a team serving an arrest warrant against Latanowich.
Although there was a date for the trial, Thomas Latanowich attorney, Joseph Krowski, has requested a new venue. He wants the case to be taken to court outside the boss and says he would guarantee a fair trial.

With more than 1,000 pages of news articles, opinion pieces, and Facebook posts on Gannon’s death, Latanowich’s past, and the aftermath of the alleged shooting as evidence, Krowski said it was allegedly impossible to obtain an impartial jury for Cape Cod. The mountain on the side shows that Gannon’s death provoked intense media coverage and that there is “extremely negative community sentiment” towards Latanowich, Krowski said.
She suggested moving the case out of Barnstable Superior Court and beyond neighboring counties to Worcester, Springfield, Lowell or Suffolk County.
“A fair trial must have a fair jury,” Krowski said. “I suggest that the record be clear. … We can’t have a trial in this county. “”
Police are highly respected on Cape Cod, Krowski said, as evidenced by the many Thin Blue Line flags on the peninsula, letters to publisher supporting officials, and grief over Gannon’s death, including people who never did. they had known.
Sgt. Sean Gannon was Awarded
Gannon received high praise and posthumous awards and recognitions in the community after his death, Krowski said. At the other end of the spectrum was Latanowich, a Somerville man whom Yarmouth police advocated for the death penalty and who called him “125” in their Facebook posts, the number of criminal entries on his release record. supervised, Krowski said. Prosecutors repeatedly identified his nickname, Tommy Guns, during grand jury testimony.
“My client, Tommy Guns, 125, the Somerville White Dumpster, is facing a lawsuit accusing him of killing a person who literally had the wings of a hospital minutes away that bears his name,” said the defense attorney. ” We really can’t believe that a (Cape Cod) community jury can really reject anything they know and what I am proposing is overwhelming evidence for the community. -Mood. ”
Michael Trudeau Justify?
Cape and Islands Assistant District Attorney Michael Trudeau reviewed the case law regarding evictions, arguing that the facts of this case did not justify removal from Barnstable County.
He said that media coverage dropped significantly after filming, and many articles available in support of Krowski’s motion did not even have Latanowich’s name.
“Relocation should be viewed with great caution and only after (a) establishing a strong evidence base,” Trudeau said. “The mere presence of a preliminary notification, even if it is extensive, is not a sufficient factual basis to request a change of location. The alleged bias is only satisfied when the advertising is broad and sensational. “”
Overall, the media coverage of Gannon’s death was largely factual, and anything that could be considered sensational happened shortly after the incident, he said.
Tuttman has requested a change of location to the board of directors.
If the story is a clue, moving to another plate can be difficult.
In his 35 years of legal practice, defense attorney Drew Segadelli has stated that he does not recall a case moved for these reasons. There are situations where the defendant is related to a clerk or a member of the prosecution that may result in the transfer of a case, but there is harmful contamination of advertising. and location. Rare.
“It’s a huge hurdle,” Segadelli said.
A court must ensure that the defendants have the right to a fair trial, the Falmouth lawyer said, adding that at the time, he would be doing the exact same thing as Krowski if Latanowich were his client. But he said his instincts told him that this case would be heard in Barnstable and a fair jury would be found.
“I think Cape Cod is pretty big,” Segadelli said.
While Tuttman considered the proposed move, the process was scheduled to begin next summer, more than three years after filming. The date may change depending on the availability of witnesses and jurors and how the pandemic is being treated.
